Consider approval of the Minutes of the March 1, 2022, City Council meeting.

OPEN FORUM/CITIZEN COMMENTS

This is the public's opportunity to address the City Council on any matter related to the City. In accordance with the Texas Open Meetings Act, Section 551.042, the City Council cannot discuss, consider, or take action on matters not listed on the agenda. The City Council will receive citizen comments on non-agenda items, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City's Public Meeting Procedures, comments will be limited to three (3) minutes.

CONSENT AGENDA

The items on the Consent Agenda are considered to be self-explanatory by the Council and will be enacted in one motion. There will be no separate discussion of these items unless requested by a Council Member.
1.

Consider approval of the preliminary plat for Buffalo Reserve, located west of Lovers Lane and north of the Skyline Estates Planned Development.

2.

Consider approval of a site plan for H.E.B., located east of the F.M. 548 and F.M. 1641 intersection.

3.

Consider approval of a final plat for the Eastgate Logistics Center Phase 1, located west of Helms Trail and north of Plantation Ridge.

4.

Consider approval of a final plat for the Eastgate Logistics Center Phase 2, located northeast of County Road 212 and S. Gateway Boulevard.

5.

Consider approval of a site plan for Forney Montessori, located southeast intersection of Pinson Road and Ridgecrest Road.

6.

Consider approval of the Forney Industrial final plat, consisting of 17.861 acres located southwest of U.S. Highway 80 and Clements Drive.

7.

Consider approval of a revised site plan for Bearded Monkey, a restaurant located at 104 E. Highway 80, Suite 120.

8.

Consider approval of a preliminary plat for Forney Marketplace Addition, Block 1, Lots 5R, 6A, and 6B located northwest of the intersection of East U.S. Highway 80 and Marketplace Boulevard.

9.

Consider approval of a final plat for Forney Marketplace Addition, Block 1, Lots 5R, 6A, and 6B located northwest of the intersection of East U.S. Highway 80 and Marketplace Boulevard.

10.

Consider approval of a site plan for Forney Marketplace Lots 6A & 6B, located east of U.S. Highway 80 and north of Marketplace Boulevard.

11.

Consider approval of a site plan for Forney Marketplace Lot 8, located east of U.S. Highway 80 and north of Marketplace Boulevard.

12.

Consider approval of a revised site plan for Forney High School, located at 1800 College Avenue.

13.

Consider approval of a final plat for the ATMOS Addition, located at the southeast corner of County Road 212 and U.S. Highway 80.

14.

Consider approval of a final plat for Overland Grove Phase 5A, a residential subdivision located west of Walnut Lane (F.M. 548) and east of S. Bois d’Arc Street (F.M. 740).

15.

Consider a Resolution approving a Professional Services Agreement with Birkhoff, Hendricks & Carter, L.L.P. to provide consulting and design services for a Sanitary Sewer Line Extension Project and all related issues.

VII.

PUBLIC HEARING ITEMS / ACTION ON PUBLIC HEARING ITEMS

1.

Hold a public hearing and discuss and consider approval of an Ordinance rezoning 40.823 acres of property from Agricultural district to a Planned Development Overlay District with a base zoning district designated as Light Industrial District. The property is located south of U.S. Highway 80, east of F.M. 1641 and west of County Road 212. [Read Ordinance Caption]

2.

Public Hearing on the proposed annexation of approximately 40.823 acres of land located in the Absalom Hyer Survey, Abstract 203 on County Road 212, owned by Platform 80-20, LP and discussion and possible action on an Ordinance approving the annexation.

VIII.

DISCUSSION / ACTION ITEMS

1.

Discuss and consider approval of a site plan for Platform 8020, located south of U.S. Highway 80, east of F.M. 1641 and west of County Road 212.

2.

Discuss and consider a Resolution approving a Development Agreement between the City of Forney and W Land Development Management, LLC for the development of an approximate 114.634 acres of land located west of Lovers Lane and north and west of the Skyline Estates Planned Development within the City of Forney.

3.

Discuss and consider a Resolution setting a public hearing under Section 372.009 of the Texas Local Government Code on the advisability of the creation of a public improvement district and improvements within the City of Forney for the Buffalo Reserve residential development, authorizing the issuance of notice by the City Secretary of Forney, Texas regarding the public hearing.

4.

Discuss and consider a resolution to hold a public hearing to receive public comments regarding the completed Roadway Impact Fee Study Update for the 2021 to 2031 planning period.

5.

Discuss and consider approval of reimbursement to GVSW Forney Property Owner, L.P. for right of way (ROW) purchase along CR 212.

6.

Discuss and take action to determine the scope of services for the ARPA consulting firm.

ANNOUNCEMENT OF COMMUNITY EVENTS

This section is used to communicate items of community interest, specifically, reminders about upcoming events organized or sponsored by the governing body or other information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the governing body that may be of interest to the citizens of Forney.

XI.

EXECUTIVE SESSION

PURSUANT TO THE OPEN MEETINGS ACT, CHAPTER 551, TEXAS GOVERNMENT CODE, THE CITY COUNCIL WILL RECESS INTO EXECUTIVE SESSION (CLOSED MEETING) TO DISCUSS THE FOLLOWING:

1.

Discuss or deliberate regarding commercial or financial information that the governmental body has received from a business prospect that the governmental body seeks to have locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations, or to deliberate the offer of a financial or other incentive to a business prospect (Tex. Gov't Code Section 551.087):

RECONVENE INTO REGULAR SESSION

IN ACCORDANCE WITH TEXAS GOVERNMENT CODE, CHAPTER 551, THE CITY COUNCIL WILL RECONVENE INTO REGULAR SESSION TO CONSIDER ACTION, IF ANY, ON MATTERS DISCUSSED IN EXECUTIVE SESSION.

XIII.

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Forney reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed on this agenda, as authorized by the Texas Government Code for the following purposes:

 Section 551.073 -- Deliberation regarding Prospective Gift
 Section 551.074 -- Personnel Matters

 This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of the agenda constitutes a written interpretation of the Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed session portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.
