Consider approval of the Minutes of the February 20, 2024 (Regular) City Council Meeting. (Staff recommends approval of the item).

OPEN FORUM/CITIZEN COMMENTS

This is the public's opportunity to address the City Council on any matter related to the City. In accordance with the Texas Open Meetings Act, Section 551.042, the City Council cannot discuss, consider, or take action on matters not listed on the agenda. The City Council will receive citizen comments on non-agenda items, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City's Public Meeting Procedures, comments will be limited to three (3) minutes.

CONSENT AGENDA

The items on the Consent Agenda are considered to be self-explanatory by the Council and will be enacted in one motion. There will be no separate discussion of these items unless requested by a Council Member.

1.

Consider approval of a Resolution approving a Municipal Services Agreement between the City of Forney, Texas and Peggy B. King in accordance with Section 43.0672 of the Texas Local Government Code prior to annexation into the city limits. (Staff recommends approval of the item.)

2.

Consider a Resolution awarding a contract to Willco Underground, LLC, for the Sanitary Sewer Relief Line Project and all related issues. (Staff recommends approval of the item.)

3.

Consider approval of a Resolution authorizing the City Manager to execute a Joint Election Contract for Joint Election Services with the Kaufman County Elections Administrator for the General Election being held on May 4, 2024, and if required a Runoff Election on June 15, 2024, for the purpose of electing three (3) Council Members, one (1) each for Place 1, Place 3, and Place 5, for three (3) year terms, at an estimated cost of $22,242.44; and providing an effective date. (Staff recommends approval of the item.)

PUBLIC HEARING ITEMS / ACTION ON PUBLIC HEARING ITEMS

1.

Public Hearing on the proposed annexation of approximately 71.29 acres of land located in the Isaac Jones Survey, Abstract A0257, on County Road 225, south of Highway 80, Kaufman County Appraisal District Property ID No. 56094, owned by Peggy King, and discussion and possible action on an Ordinance approving the annexation. (Staff recommends approval of the item.)

DISCUSSION / ACTION ITEMS

1.

Discuss and consider approval of a Resolution accepting a market rate adjustment requested by Community Waste Disposal in accordance with the solid waste and recycling services agreement. (Staff recommends approval of the item.)

2.

Consider approval of a Resolution approving an Agreement for Concession Services with Maretate Inc. dba The Little Egg, for Mulberry and Community Park Concession Stands. (Staff recommends approval of the item.)

3.

Discuss and consider action on a Resolution approving an expenditure under Section 501.073 Texas Local Government Code and an Economic Incentive and Performance Agreement between the Forney Economic Development Corporation and Mix It Up Creamery, LLC (Staff recommends approval of the item.)

4.

Discuss and consider approval of an Ordinance amending Section 3.09, “Multi-Family and Single-Family Rental Property Registration and Inspection,” to update registration and inspection fees related to the rental registration program, provide a crime prevention lease clause, and make other various amendments. (Staff recommends approval of the item.)

5.

Discuss and consider approval of an Ordinance creating a Crime Control and Prevention District with the power to levy a sales and use tax subject to voter approval; creating a temporary board of directors to formulate a two-year crime control and prevention plan and budget plan. (Staff recommends approval of the item.)

6.

Discuss and consider approval of a Resolution appointing the temporary Board of Directors to the Forney Crime Control and Prevention District, giving direction to the Board of Directors to formulate a two-year crime control and prevention plan and budget plan. (Staff recommends approval of the item.)

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Forney reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed on this agenda, as authorized by the Texas Government Code for the following purposes:

This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of the agenda constitutes a written interpretation of the Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed session portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.
